Please carefully read these Terms and Conditions. Any mention of these terms (“Company”, “we”, “our”, “us”), reflect LuxGrafix Studios LLC.
These Terms of Service will govern your use of our website (www.luxgrafix.com) operated by LuxGrafix Studios LLC. These Terms and Conditions aim to provide the foundation for a good working relationship between both of us, LuxGrafix Studios LLC (“LuxGrafix Studios”) and you (the “client”). These terms are fundamental toward the agreement between LuxGrafix Studios and you the Client. Our Privacy Policy also governs your usage of our website (www.luxgrafix.com) and explains how we collect, use and protect information that results from your use of our web pages at (www.luxgrafix.com).
Coming into agreement with us includes these, our Terms of Service as well as our Privacy Policy (“Agreements”). You outright acknowledge that you have read, understood and agree to be bound to them and see them as legally binding. If you do not agree with (or cannot reasonably comply with) said agreements, then you may not at any time utilize any of the listed services at LuxGrafix Studios LLC. However, do let us know by emailing your concerns/queries to support@luxgrafix.com so that we can seek resolution that satisfies both parties completely. These Terms apply to all visitors, users and others who wish to access or use any of our listed Service(s) on our website (www.luxgrafix.com).
The following Terms and Conditions of Service apply to all services rendered by LuxGrafix Studios LLC and in the event of any dispute are solely governed by the laws and regulations of Trinidad and Tobago.
Scope of Project
Upon the submission of your project request (“design brief”) via the relevant forms, you will be contacted for further information and notified orally of the intended timeframe. This timeframe will coincide (unless requested and otherwise agreed upon) the mentioned timeframe listed within the description of the selected service.
The initial design concept will then be submitted to you for your review via the communication channel you most prefer (WhatsApp, Email or SMS). Any feedback provided by you (“the client”) will be applied to design.
Revisions
Each round of revisions will accommodate any number of requests. Upon submission of artwork after said round of requests, any further requested amends will be treated as a new round of revisions. If you have exhausted your allotted revision requests, you may purchase additional ones. We however, do ask of you to review any submitted artwork thoroughly, so that you get the most out of each round of revisions.
Client Corrections
Client Corrections are any changes that are made subsequent to the initially provided design brief, consultation or first draft. Do note that once, work has commenced, any corrections (“name of event”, “Main heading/Call to Action”, “Design layout”) that are changed in its entirety, will be treated as a revision in and of itself, without request for further amends. If you have exceeded your allotted revision requests when making this change, then only upon payment for a new round of revisions, will the requested amend be made.

Ownership – Upon final delivery, you (“the client”) will have full ownership of ONLY the agreed and finalized design and can therefore use your deliverables in any way that best suits your business. We (“LuxGrafix Studios”) will maintain the rights to all source files, sketches, drafts and use of the final or any previously rejected versions of the design within our marketing, promotional materials and our online portfolios. Upon submission, you (“the client”) also give us (“LuxGrafix Studios”) the right to use your name (“first and last, “first only”, “first name with last name’s initial”) for testimonial purposes or any other LuxGrafix Studios related channels, including our social media.
Delays & Liabilities – Accident, Incident, Injury, Illness or event naturally occuring or otherwise (“fire, storm”, “theft”, “computer/harddrive failure”) can cause certain delay without calculable length. In that event, you (“the client”) will be notified immediately and options that satisfy both parties will be listed.
LuxGrafix Studios does not in any way guarantee that the design process will be without error or interruption where usage on your (“the client”) part. In no event will we, LuxGrafix Studios, be held liable to you (“the client”) or any third-party for damages of any kind (“loss of profit”, “loss of savings”, “incidental and or “unique and significant damages, that stem from any reproduction of or likeness shared”). In the event that we have been advised that such can potentially be the case, we will advise you (“the client”) accordingly and proceed only with your approval. Once deliverables have been sent to you, we cannot and will not be included in any case that may come against you.
Cancellations & Refunds – If the given deadline is missed, without any prior or acceptable notice from us, (“LuxGrafix Studios”) you (“the client”) can cancel your pending project with full refund. If however, the project has commenced and or the first draft has been submitted, cancellations will only allow a refund of 50%. Any project taken to its full stipulated length with 3 or all revisions exhausted, will be cancelled as requested but no refund will be released to you (“the client”). All source files, (except the .aep) at the point of cancellation will be rendered to you.
ALL cancellations must be communicated in writing via our email – support@luxgrafix.com OR via verbal communication in the form of a direct call or a WhatsApp call.

For website requests, please have the purchase of your domain readily available, as we cannot promise the domain name that you’d prefer would be available. The option for hosting will be provided by us for an additional fee, unless you have already purchased yours.

Revisions
Each round of revisions will accommodate any number of requests. Upon submission of the website design, you are allowed to make 2 rounds of revisions. When the layout of the website has begun and the first draft via hosting has been forwarded to you for interaction, you will be allotted 3 complete rounds of revisions. When each round of requests has been exhausted, you may purchase additional ones. We however, do ask of you to review all that is submitted to you for review thoroughly, so that you get the most out of each round of revisions.
Client Corrections
Client Corrections are any changes that are made subsequent to the initially provided design brief, consultation or first draft. Do note that once, work has commenced, any corrections (“Complete Wireframe Change – Section, Header, Footer, Page”, “Redesign of Banners” “etc”) that drastically changes it in its entirety, will be treated as a revision in and of itself, without request for further amends. If you have exceeded your allotted revision requests when making this change, then only upon payment for a new round of revisions, will the requested amend be made. This is non-negotiable.

Do note that we (“LuxGrafix Studios”) reserve the right to refuse any material that does not align with our ethics. Any project that breaches the following can and will be cancelled with full refund to you and may be without given reason upon cancellation. These projects would be ones that includes any text, imagery or data of any kind that displays nudity of any kind (“partial or complete nudity”), appears to be offensive (“racially, sexually, religiously”), obscene or unequivocally illegal.
If at any point you (“the client”) places an order and have not communicated with us (“LuxGrafix Studios”) via any channel of communication for a maximum of seven (7) days, the project will commence and you will forfeit a full refund. This can be changed on a project-by-project basis.
Do note also, if at any point after you have created the order, without any given information on how to proceed and we are unable to reach you for a maximum of 7 days without any prior communication from you (“the client”), your order would be placed on pause for a maximum of twenty-one (21) days and closed thereafter with partial payment forfeited. This can be circumvented if we (“LuxGrafix Studios”) are advised prior to the gap in communication, that time is needed.
If no communication is received prior to you (“the client”) leaving the project open after your first draft and or second draft(s) have been submitted, the project will be closed after fifteen (15) days and refund forfeited. To re-open that project, will require a re-opening fee. These fees can be removed in the event there was a pressing matter or life-changing event.
Please note that all payments will be processed on our SSL Encrypted website (www.luxgrafix.com). Upon purchase of any service made available through LuxGrafix Studios, you will be asked to provide information that is relevant to the completion of your purchase. This can include but is not limited to, your first and last name, your billing address, your email address, your credit or debit card and the expiration date of said card. Your information may be stored by our third-party payment processors. By reading these terms and submitting your order, you implicitly agree without issue, as per our privacy policy.
If your transaction is flagged as fraudulent your order will be canceled immediately.
We at LuxGrafix Studios truly do love what we do and are happy to serve you. Before you confirm your agreement to all the listed terms and conditions above, please ensure you understand fully.
